Terms of use

By using this application you accept these terms. If you do not accept them, please do not use it.

1. Provider and scope

This application is provided by Example Company GmbH, Example Street 1, 12345 Example City, Germany ("we", "us"). These terms govern your use of the application and the website on which it is offered.

2. What the application is

The application estimates the length of a foot from a photograph in which a sheet of paper of known size is visible. It is offered free of charge and as an aid for orientation only.

It is not a calibrated measuring instrument, not a medical device, and not a substitute for professional foot measurement or medical, orthopaedic or podiatric advice. It must not be used where an incorrect result could affect health or safety.

3. Accuracy, and what it depends on

The result is an estimate. Its accuracy depends on factors that are entirely within your control and outside ours, in particular:

• the quality, sharpness and lighting of the photograph;
• whether the sheet of paper lies completely flat and is fully visible;
• whether the paper size you selected is the paper you actually used;
• the angle from which the photograph was taken;
• and above all how precisely you place, check and confirm the markers for the corners of the sheet, the toe and the heel before starting the calculation.

Where the application suggests marker positions automatically, those suggestions are a convenience and may be wrong. You are responsible for verifying every marker before you start the calculation. Pressing the calculate button is your confirmation that the markers are placed correctly.

We give no warranty that any result is accurate, complete or fit for any particular purpose.

4. Your responsibility

You decide what you measure, how carefully you measure it, and what you do with the result. In particular you are responsible for:

• taking a suitable photograph and placing the markers correctly;
• checking the plausibility of the result, and repeating the measurement if it looks wrong;
• every decision you base on the result, including purchases, returns and the selection of footwear for yourself or for others;
• obtaining the consent of any other person whose foot you measure.

A shoe size derived from a foot length is a further estimate: sizing differs between manufacturers, models and countries. We are not responsible for footwear that does not fit.

5. Availability

The application is provided "as is" and "as available". We do not guarantee uninterrupted availability, and we may change, restrict or discontinue it at any time without notice.

6. Liability

This application is provided free of charge as an aid for orientation. We are liable only for the breach of an obligation whose fulfilment is essential to the proper performance of this service and on whose observance you may regularly rely, and only for foreseeable damage typical of this kind of service.

Any further liability is excluded. In particular we are not liable for inaccurate measurement results, for decisions taken on the basis of a result, or for costs arising from the purchase or return of footwear.

7. Intellectual property

The application, its design, text and software are protected by copyright and remain our property or that of our licensors. You may use the application for its intended purpose. You may not copy, decompile, redistribute or offer it as your own service without our written consent.

8. Changes to these terms

We may amend these terms. The version published here at the time of your use is the one that applies.

9. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

10. Severability

Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
